Acceptance of These Terms

These Terms of Service (“Terms”) form a binding agreement between you and bnbooked.com (“bnbooked.com”, “we”, “us”, or “our”). By creating an account, connecting calendar feeds, or otherwise using the bnbooked.com platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the service immediately.

Who Can Use the Service

You must be at least 18 years old and capable of entering into legally binding contracts to use bnbooked.com. You represent and warrant that the information you provide during sign-up is accurate, and that you will promptly update it if anything changes.

What the Platform Does

bnbooked.com aggregates short-term rental data and availability by ingesting iCalendar (“ICS”) feeds and related information from third-party online travel agencies (OTAs) and property management tools. We normalize event data, combine feeds, calculate analytics, and display the status of your properties in a unified dashboard. The service may also cache feeds, flag reservations, and expose merged calendars for use in your workflows.

bnbooked.com does not host or sell accommodations, does not mediate bookings, and does not endorse or control any reservation made through an OTA or other third-party platform.

Third-Party Feeds and Services

Your ability to view accurate availability depends on data supplied by third parties, including OTAs that issue ICS feeds or APIs. Those providers may delay, throttle, alter, geo-restrict, or block access to their feeds without notice. You acknowledge that:

• bnbooked.com does not control the content, uptime, or formatting of OTA feeds;
• feeds may include incomplete, stale, duplicative, or mislabelled events;
• OTAs may prevent access to your feeds or require additional verification at any time;
• we are not responsible for OTA outages, policy changes, rate discrepancies, or booking disputes.

You should always confirm availability and reservation details directly with the OTA or booking system before relying on the information surfaced in bnbooked.com.

Your Responsibilities

• Maintain control of your login credentials and promptly notify us of any suspected misuse.
• Ensure the accuracy of property data, calendar URLs, and labels that you submit to the platform.
• Comply with all laws, OTA terms, and contractual obligations that apply to your properties and guests.
• Use the service only for lawful management of your rental inventory; do not reverse engineer, probe, or overload our systems.
• Ensure you have the right to grant bnbooked.com access to any data or third-party services you connect.

Data and Privacy

We collect and store account details, property metadata, merged calendar information, usage logs, and any documents or notes you upload in order to provide, secure, and improve the service. We may use aggregated or anonymized data to generate insights, improve detection of calendar conflicts, and optimize performance. By submitting data or connecting third-party feeds, you grant bnbooked.com a non-exclusive, worldwide, royalty-free license to host, store, cache, reproduce, and display that content solely for operating and improving the platform. You retain ownership of your data at all times.

Service Changes and Availability

We continually iterate on the platform and may add, modify, or discontinue features without prior notice. We aim for high availability but cannot guarantee uninterrupted access. Planned maintenance, unexpected outages, software defects, or upstream provider issues may temporarily affect the service. We are not liable for any loss, including lost bookings or revenue, that results from downtime or feature changes.

Fees and Future Changes

The Service is currently offered free of charge. bnbooked.com reserves the right to introduce paid features or subscription plans in the future. If pricing changes are made, users will receive reasonable advance notice and may choose to discontinue use before such changes take effect.

Beta Features

From time to time, bnbooked.com may release beta or experimental features that are still in testing or evaluation. Such features may contain errors or behave unpredictably and are provided on an “as is” basis without warranty of any kind. You acknowledge that use of beta features is at your own risk and that bnbooked.com may modify or discontinue them at any time without notice.

Intellectual Property

bnbooked.com owns all rights, title, and interest in the platform, including its software, user interface, analytics, and branding, excluding your own content and that of third parties. You may not copy, distribute, modify, or create derivative works of our intellectual property unless expressly permitted in writing.

Feedback

If you provide feedback, feature ideas, or improvements, you grant us the right to use that input without restriction or obligation to you. We appreciate the help and may, at our discretion, acknowledge contributors.

Disclaimers

While we strive to maintain reliable and accurate functionality, the Service is provided on an 'as is' and 'as available' basis. We make no warranties, express or implied, about uninterrupted operation, accuracy of calendar merges, or ongoing access to third-party feeds. Users are responsible for verifying data directly with their booking platforms.

bnbooked.com provides the Service as a technical tool for aggregating calendar data. We make no representations or warranties of any kind about the completeness, reliability, or accuracy of the information displayed. To the fullest extent permitted by law, we disclaim all responsibility for damages or losses resulting from bugs, data corruption, misconfigurations, third-party API restrictions, OTA policy changes, or feed unavailability. You use the Service entirely at your own risk and agree that your sole remedy for dissatisfaction is to stop using it.

You are solely responsible for validating the accuracy and completeness of any availability, pricing, or reservation information before acting on it. bnbooked.com makes no commitment to maintain backups or store your content and disclaims responsibility for any data loss or corruption.

No Professional Advice

The Service and any information, analytics, or insights provided through bnbooked.com are for informational purposes only. They do not constitute legal, financial, or professional advice. You are solely responsible for evaluating the accuracy and applicability of any data or recommendations and for making decisions based on your own judgment or professional consultation.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BNBOOKED.COM AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST BOOKINGS, LOST REVENUE, LOST DATA, GOODWILL, OR BUSINESS INTERRUPTION. THIS APPLIES EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOU ACKNOWLEDGE THAT NEITHER BNBOOKED.COM NOR ANY OF ITS AFFILIATES WILL BE RESPONSIBLE FOR DAMAGES OR LOSSES RESULTING FROM OTA POLICY CHANGES, OTA-INITIATED FEED BLOCKS, MALFORMED ICS FILES, SOFTWARE BUGS, OR ANY MALFUNCTION IN THE SERVICE.

To the fullest extent permitted by law, bnbooked.com shall not be liable for any damages or losses arising from the use or inability to use the Service. In no event shall our total liability exceed fifty euros (€50).

Your sole and exclusive remedy for any dissatisfaction with the Service is to stop using the Service and, where applicable, delete your account.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence, fraud, or willful misconduct. These Terms do not affect any non-waivable statutory rights under applicable consumer law.

Indemnification

You agree to defend, indemnify, and hold harmless bnbooked.com and our affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to (i) your use of the service, (ii) your violation of these Terms, (iii) your violation of any third-party rights, or (iv) disputes with OTAs, guests, or other service providers linked to your properties.

Suspension and Termination

We may suspend or terminate your access at any time if we reasonably believe you violated these Terms, endangered the platform, or used the service in a fraudulent, abusive, or unlawful manner. You may terminate your account at any time by contacting support; termination requests may take up to 30 days to process in our systems and caches.

Force Majeure

bnbooked.com shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, power outages, network failures, data center disruptions, strikes, labor disputes, war, terrorism, pandemics, or actions by third-party providers such as OTAs or hosting platforms.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Lisbon, Portugal.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the service or by email. Your continued use of bnbooked.com after the updated Terms become effective constitutes acceptance of the changes.

General

These Terms constitute the entire agreement and supersede any prior agreements between you and bnbooked.com regarding the service. If any provision is held invalid, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations at any time as part of a merger, acquisition, financing, or other corporate transaction.
